(BURLINGTON, ON) A driver was arrested and charged criminally with driving and firearms offences after he was caught driving while serving a 1-year drivers licence suspension because of a Criminal Code impaired driving conviction.

On Saturday, October 25, 2025, at 10:31 a.m., an Officer from the Burlington Detachment was conducting speed enforcement on Highway 6 near Leeming Rd in Hamilton. Automatic Licence Plate Recognition (ALPR) technology registered a hit on a passing vehicle alerting the Officer to the suspended driver.

The vehicle was stopped and the lone occupant, the registered owner of the vehicle, was arrested for driving while prohibited. Additionally, it was suspected by the officer that the driver had consumed alcohol recently and a breath demand was issued. The driver registered an Alert on a roadside Approved Screening Device (ASD) resulting in an additional 3-day drivers licence suspension. A prohibited firearm that was being transported and stored insecurely was also seized from the vehicle at the roadside.

As a result of the investigation, Jamie KILPATRICK, a 28-year-old male from Hamilton has been charged with:

Operation While Prohibited Under the Criminal Code

Careless Storage of Firearm, Weapon, Prohibited Device or Ammunition

Unauthorized Possession of a Prohibited or Restricted Firearm

Occupant of Motor Vehicle Knowing there was a Prohibited or Restricted Weapon

The accused was released from custody and is set to appear on December 19th, 2025, at the Ontario Court of Justice, Hamilton.

Owners of firearms are required to adhere to the Firearms Act in relation to the possession, storage, transportation and display of firearms. Owners should ensure they monitor and are aware of any changes to legislation and regulations that may affect the firearms in their possession.
